Summary

Rule 13 establishes an affirmative action framework within the state’s procurement policy. It mandates that government departments must prioritize purchasing goods and services from local Small Scale Industries (SSIs) and entrepreneurs belonging to Scheduled Castes (SC), Scheduled Tribes (ST), and Other Backward Classes (OBC), provided their price and quality are reasonable. Additionally, it offers specific financial incentives and preferences to recognized Startups in Chhattisgarh, allowing them to secure orders if they match the lowest bid (L-1), subject to certain caps.

Key Takeaways

  • Mandatory Preference: Departments must purchase from local SC/ST/OBC/SSI units if their quality is reasonable and price is competitive.
  • Startup Incentive: Valid Startups matching the L-1 rate can get orders up to 1% of the total purchase value (Max ₹10 Lakhs/year) for 3 years.
  • Electronic Products: Procurement of IT and electronic goods is governed by specific Central Government notifications regarding domestic manufacturing.

Key Analysis

  • Socio-Economic Justice: This rule operationalizes the constitutional mandate of social justice by ensuring that government spending directly supports marginalized communities (SC/ST/OBC) and local industries.
  • Conditional Preference: The preference is not absolute; it is contingent upon “Reasonable Price” and “Quality.” This balances fiscal responsibility with social welfare.
  • Startup Ecosystem Support: By allowing Startups to match the L-1 price and securing a portion of the order, the rule lowers the entry barrier for new companies that might otherwise struggle to compete with established players on volume.

Key Ingredients

  • Purchaser: Government Department or Agency.
  • Beneficiary A: Local SSI, SC, ST, or OBC entrepreneur.
  • Beneficiary B: Valid Startup (Recognized by Govt of India & established in CG).
  • Condition: Price and Quality must be reasonable/justified.
  • Startup Limit: Max ₹10 Lakhs/year preference for 3 years.

Practical Illustrations

Example 1: SC/ST Entrepreneur PreferenceThe Tribal Welfare Department needs to purchase office furniture. A local furniture unit run by an ST entrepreneur offers the required chairs. If the quality meets the department’s standards and the price is comparable to market rates (reasonable), the department is obligated under Rule 13 to purchase from this unit rather than a large external corporation.
Example 2: Startup Price MatchingA Chhattisgarh-based recognized Startup bids ₹1,05,000 for a software contract. The lowest bidder (L-1) is a large firm bidding ₹1,00,000. If the Startup agrees to match the L-1 price of ₹1,00,000, the department can award them the contract (up to ₹10 Lakhs value) to encourage their growth.

Frequently Asked Questions

Does this rule apply to all Startups in India?
No. The rule specifically mentions Startups established in Chhattisgarh that are recognized by the Government of India.
Can a department buy from an SC/ST entrepreneur if their price is much higher than the market rate?
No. The rule requires the price to be “reasonable” (औनचत्यपूिय). While preference is given, it does not allow for paying exorbitant prices above market standards.
What happens if the local industry cannot produce the required quantity?
The mandatory purchase is limited to the “registered production capacity” of the unit. If the requirement exceeds their capacity, the department can procure the balance from other sources.

Conclusion

Rule 13 serves as a vital instrument for inclusive economic growth within Chhattisgarh. By mandating preferences for SC/ST/OBC entrepreneurs and providing tangible financial incentives for Startups, the government ensures that public procurement acts as a catalyst for local business development while maintaining checks on quality and pricing.
