Summary

Rule 8 establishes specific exemptions from the standard competitive tender process for government procurement in Chhattisgarh. It mandates that government departments must directly purchase certain categories of goods—such as handloom textiles, handicrafts, organic manure (vermi-compost), and herbal medicines—from designated state government undertakings, cooperative federations, and Self-Help Groups (SHGs). This rule is designed to foster the state’s internal economy, support rural industries, and ensure the viability of welfare schemes like the Godhan Nyay Yojana.

Key Takeaways

  • Direct Purchase Exemption: No separate tender is required for purchasing goods specified in this rule from the designated state agencies.

  • Designated Sellers: Purchases must be routed through specific bodies like the C.G. State Handloom Development & Marketing Cooperative Federation, Khadi Board, or C.G. State Minor Forest Produce Federation.

  • Godhan Nyay Yojana: Organic manure (Vermi-compost) produced by Gothans must be purchased directly at rates fixed by the Agriculture Department.

  • Forest Produce: Ayurvedic medicines and herbal products must be bought from the Minor Forest Produce Federation.

Key Analysis

  • Economic Circularity: This rule ensures that state funds remain within the state’s economic ecosystem by mandating purchases from state-run federations and cooperatives, effectively subsidizing and supporting local production.

  • Empowerment of SHGs: By explicitly mentioning Self-Help Groups (SHGs) under Women & Child Development and Panchayat departments, the rule provides a guaranteed market for micro-enterprises, reducing their marketing risks.

  • Rate Standardization: Unlike open tenders where the lowest bidder (L1) wins, purchases here are made at rates fixed by the respective controlling departments (e.g., Agriculture Dept for compost, MFP Federation for herbal products), preventing undercutting that could hurt quality or artisan wages.

Key Ingredients

  • Seller Identity: Must be a Govt Department, Undertaking, Cooperative Federation, or registered SHG.

  • Product Category: Handloom, Handicrafts, Vermi-compost, Herbal/Ayurvedic products, or items manufactured by departmental units.

  • Pricing: Rates must be fixed/approved by the controlling department or federation.

  • Procedural Exemption: No requirement to issue a public tender (Rule 4 exemption).

Practical Illustrations

Example 1: Office Curtains
The District Collectorate needs new curtains for the conference hall. Instead of floating a tender, they directly place an order with the “Chhattisgarh State Handloom Development & Marketing Cooperative Federation Ltd.” under Rule 8.3.
Example 2: Forest Department Supplies
The Forest Department requires organic manure for a plantation drive. They purchase Vermi-compost directly from a local Gothan registered under the Godhan Nyay Yojana at rates fixed by the Agriculture Department, utilizing Rule 8.5.
