Part 5 of Indian Constitution The Union

Part V of the Constitution outlines key provisions for the operation of the Union Government in a parliamentary system. It establishes the foundation for an independent judiciary and ensures an effective separation of powers within the government.

Article 52 of Indian Constitution

Article 52 of the Indian Constitution designates the President as the highest authority in the nation. The President holds executive powers, represents the country, ensures the Constitution is upheld, and works in collaboration with other branches of government to promote the welfare and unity of the nation.

Article 53 of Indian Constitution-Executive power of the Union

Article 53 of the Indian Constitution states that the President of India exercises their powers and performs their duties in accordance with the Constitution. The President acts on the advice of the Council of Ministers, appoints high-ranking officials, and has the authority to grant pardons, reprieves, and remissions of punishment.

Article 54 of Indian Constitution – Election of President

Article 54 of the Indian Constitution establishes the method for electing the President. The President is elected by an Electoral College consisting of elected members of both houses of Parliament and the Legislative Assemblies of the states. The election is conducted through a system of proportional representation and a secret ballot.

Article 55 of Indian Constitution – Manner of election of President

Article 55 of the Indian Constitution outlines the manner of the election of the President.

  1. Article 55 of the Indian Constitution ensures uniformity in the scale of representation among states during the election of the President.
  2. The number of votes each elected member of Parliament and the Legislative Assembly is entitled to cast is determined based on the population of their respective state.
  3. The election of the President follows a system of proportional representation through the single transferable vote method.
  4. Voting in the Presidential election is conducted by secret ballot, ensuring the privacy and confidentiality of the voters.
  5. The population referred to in Article 55 is determined based on the figures of the last preceding census, with the 1971 census as the reference until the figures of the first census after 2026 are published.

Article 56 of Indian Constitution – Term of office of President

Article 56 of the Indian Constitution empowers the President to hold office for a term of five years, unless sooner resigned or removed. The article specifies that the President’s term can be extended during a national emergency for a period not exceeding one year at a time.

Article 57 of Indian Constitution – Eligibility for Re-Election

Article 57 of the Indian Constitution states that a person who currently holds or has previously held the office of President is eligible for re-election, provided they fulfill the other requirements mentioned in the Constitution. This article allows for the possibility of a President serving multiple terms through re-election.

Article 58 of Indian Constitution – Qualifications for election as President

Article 58 of the Indian Constitution outlines the eligibility criteria for a person to be elected as President. The requirements include being a citizen of India, being at least 35 years old, and being qualified to be elected as a member of the Lok Sabha (House of the People). Additionally, a person cannot be eligible if they hold any office of profit under the government, state, or any other authority controlled by these governments.

Article 59 of Indian Constitution – Conditions of President’s office

Article 59 of the Indian Constitution lays down the conditions regarding the President’s office:

  1. The President cannot be a member of either House of Parliament or any State Legislature. If a member of either house is elected President, they will be deemed to have vacated their seat upon assuming the office of the President.
  2. The President cannot hold any other office of profit.
  3. The President is entitled to use official residences without paying rent and receives emoluments, allowances, and privileges as determined by Parliament. Until a law is enacted, the Second Schedule specifies these benefits.
  4. The emoluments and allowances of the President cannot be reduced during their term in office.
